Terms of Service
The short version
Use the bot and the site for what they are for, do not abuse them, and do not treat anything an AI tells you as advice you can rely on without checking. We can change or withdraw the service. We are not liable for what you do with its output.
The sections below are the binding version, but there is nothing in them that contradicts the paragraph above.
1. Agreement
These terms apply when you use the Never Absolute website at neverabsolute.com, the assistant on that website, or the Never Absolute Discord bot. Together we call these the Service. By using the Service, including by adding the bot to a Discord server, you agree to these terms. If you do not agree, do not use it.
If you add the bot to a server you administer, you are agreeing on behalf of that server, and you are responsible for making its members aware of these terms and of our Privacy Policy.
2. What the Service is
The Service provides automated, AI generated responses and related automation features. It is offered free of charge unless we have agreed something different with you in writing.
Use of the bot is also subject to the Discord Terms of Service and Community Guidelines. Where those are stricter than these terms, those apply.
3. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to harass, defraud, threaten or harm anyone.
- Attempt to extract our system instructions, jailbreak the assistant, or make it produce content outside its purpose.
- Automate, script or otherwise flood the Service, or attempt to run up our costs deliberately.
- Use the Service to generate spam, malware, or content that infringes someone else's rights.
- Resell, sublicense, or present the Service as your own product.
- Submit payment details, passwords, government identifiers, or other people's personal data.
We apply rate limits to keep the Service available and affordable. Working around them is a breach of these terms.
4. AI output
This is the section we would most like you to read.
The Service produces output from a language model. That output can be wrong, out of date, or confidently invented, including about our own prices and services. It is provided for general information only. It is not professional, legal, financial, medical or technical advice, and it does not create a client relationship with us.
Nothing the assistant or bot says is a quote, an offer, a contract or a commitment on our part. Anything that matters commercially is agreed by a person, in writing. Check anything important before you act on it.
5. Availability
We make no promise that the Service will be available, uninterrupted or error free. We may change it, suspend it, or withdraw it entirely, at any time and without notice. We may also remove the bot from a server at our discretion.
6. Suspension and termination
We may block your access, or the access of an entire Discord server, if these terms are breached or if the Service is being abused. You can stop using the Service at any time by removing the bot from your server or closing the chat window. To have data deleted afterwards, see the Privacy Policy.
7. Intellectual property
The Service, including the Never Absolute name, branding, site content and underlying software, belongs to us. These terms grant you a limited, revocable, non exclusive right to use the Service as intended, and nothing more.
You keep ownership of anything you send us. You grant us permission to process it in order to operate the Service and to reply to you, as described in the Privacy Policy.
8. Liability
To the fullest extent the law allows, the Service is provided “as is”, without warranties of any kind, and we are not liable for any indirect or consequential loss, loss of profit, loss of data, or business interruption arising from your use of it or your reliance on its output.
Where liability cannot lawfully be excluded, our total liability is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred Singapore dollars.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
9. Changes to these terms
We may update these terms. The date at the top shows when they last changed. Continuing to use the Service after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute, without affecting any mandatory consumer rights you have where you live.
